Sustainability Claims, Green Claims and Packaging Obligation in the European Union

For the time being, no harmonization exists for ""green"" claims and for ""sustainability"" claims, whereas there is a growing demand from consumers and the society in general. Such claims have therefore become a competitive asset among producers. A lot of private standards are now offered, with very different criteria which are not known by the consumers, while at the same time the general prohibition to mislead consumers and make false or ambiguous statements is laid down in all jurisdictions. In the EU, some member states have already laid down some specific rules on ""green"" and ""sustainability"" claims and advertising. They have also imposed obligations regarding indication of recyclability for packaging. This is the case for France. The European Commission has proposed a revision of the general regulation regarding misleading advertising, which is currently under discussion, with a view to have common rules all over the Union on environmental claims.  In the same period of time, however, legislations regarding packaging and waste have been developed and have created obligations for operators. We will present existing rules in the EU and discuss whether the current situation already provides some guarantees to consumers, as well as some harmonization between jurisdictions.  Speakers: Emily Amat, MS, Nicole Coutrelis
